Sanusi`s N50m Damages: SSS Appeals Judgment

Unsatisfied with Lagos State High Court’s ruling on Thursday ordering them to pay N50 million and apologise publicly to suspended Governor of Central Bank of Nigeria (CBN), Mallam Sanusi Lamido Sanusi, the State Security Service (SSS) has filled an appealed.

According to a statement on Friday, by Spokesperson for SSS, Ms. Marilyn Ogar, the security organisation finds Justice Ibrahim Buba’s judgement on the matter very unsatisfactory and would not accept such.

Ogar maintained that everything the SSS did, including seizing Sanusi’s passport, was in accordance with the law, saying by impounding Sanusi’s passport, the SSS acted in accordance with the law.

“Our action is backed by Section 3(2) (b) of Instrument SSS No. 1 of 1999, made pursuant to Section 6 of the National Security Agencies (NSA) Act”, she said in the statement.

Ogar quoted parts of the instrument in the statement.

 “The State Security Service is hereby empowered to impound and keep in its custody the passports or any other property of persons or organizations under investigation if considered appropriate by the Director General”, the document said.

“Returns of all such seizures shall be rendered to the National Security Adviser, while such passports shall be returned to the owners as soon as the investigation is concluded. It is therefore necessary to state that in impounding the passport of Mallam Sanusi Lamido, the Service acted in accordance with the law.

“Consequently, the Service has taken immediate steps to appeal this rather erroneous judgement. Notwithstanding, this Service holds and continues to hold the judiciary in high esteem as critical partners in nurturing our democracy and nation building.”

Sanusi had taken the SSS to court asking it to enforce his fundamental human rights. He had begged the court to declare as unlawful, the sizure of his international passport by the SSS.

Presiding judge, Justice Ibrahim Buba had obliged Sanusi’s request and awarded him N50 million damage cost and orderd the security organization to apologise to Sanusi publicly.
